Referring to a navigation channel, which was the subject of the first submission to the Committee, by Romania regarding Ukraine's compliance with the Convention, "the Committee is of the opinion that for the purpose of the procedures under the Convention, in particular article 2, paragraph 3, such an activity includes not only construction but also operation and maintenance works" (decision IV/2, annex I, para. 41).
15. Au sujet du canal de navigation qui faisait l'objet de la première communication, soumise par la Roumanie et concernant le respect par l'Ukraine des dispositions de la Convention, le <<Comité a estimé qu'aux fins des procédures prévues dans la Convention, en particulier du paragraphe 3 de l'article 2, une telle activité englobe non seulement la construction, mais aussi les travaux d'exploitation et de maintenance>> (décision IV/2, annexe I, par. 41).
