2.3 The author indicates that according to regulatory decree No. 1160 of 1989, "for the purposes of pension transfers, the person who shared married life with the deceased during the year immediately preceding the death of the deceased or during the period stipulated in the special arrangements shall be recognized as the permanent partner of the deceased"; the decree does not specify that the two persons must be of different sexes.

6.5 The question therefore arises whether the investigative measures taken by the State party's authorities, in particular by the Belgrade deputy public prosecutor, were commensurate to the requirement of article 12 of the Convention to proceed to a prompt and impartial investigation of the events preceding the death of N.N. In this regard, the Committee notes the complainants' uncontested claim that the deputy public prosecutor advised them already on 22 April 1994, i.e. three days before the autopsy, that he would not initiate criminal proceedings ex officio, as he considered their son's death an accident, and that he did not examine any of the witnesses named by their lawyer.
6.5 В этой связи возникает вопрос, соответствовали ли следственные мероприятия, предпринятые компетентными органами государства-участника, в частности заместителем государственного прокурора Белграда, требованию статьи 12 Конвенции о проведении быстрого и беспристрастного расследования событий, предшествующих смерти Н.Н. В этой связи Комитет принимает к сведению неоспариваемое утверждение заявителей о том, что заместитель государственного прокурора сообщил им уже 22 апреля 1994 года, т.е. за три дня до проведения вскрытия, что он не будет возбуждать уголовное производство ex officio, поскольку он считает смерть их сына несчастным случаем, и что он не будет опрашивать никого из свидетелей, названных их адвокатом.
