This provision, accepted by the people and the cantons on 14 June 1981, contains three elements. Firstly, it defines a fundamental right (first sentence); secondly, it gives the legislature a mandate to provide for equality (second sentence); finally, in the last sentence it sets forth a directly applicable fundamental right, namely the right to equal pay for work of equal value.
35. Cette disposition, acceptée par le peuple et les cantons le 14 juin 1981, contient trois éléments : elle contient d'abord un droit fondamental (1ère phrase); en second lieu, elle confie un mandat au législateur de pourvoir à l'égalité (2ème phrase) et enfin, la dernière phrase énonce un droit fondamental directement applicable, à savoir le droit à un salaire égal pour un travail de valeur égale.
