With regard to the recommendation made in paragraph 12 of the concluding observations concerning cessation of the imposition of cruel, inhuman and degrading punishments incompatible with article 7 of the Covenant, such as amputation of an ear, amputation of a right hand below the wrist and branding, as illustrated by Revolutionary Command Council Decree No. 109 of 18 August 1994 which stipulated that any person whose hand had been amputated for a crime thus punishable by law should be branded between the eyebrows with an "X" symbol and that this provision would apply retrospectively to persons whose hands had already been amputated, after 2003 these punishments were classed among the crimes against humanity for which provision was made in chapter II, section 2, article 12, paragraph 1 (j), of Act No. 10 of 2005 promulgating the Statute of the Iraqi Supreme Criminal Tribunal (see the annex concerning this Statute).
