125. Les fouilles corporelles des prévenus au moment de leur arrestation sont effectuées en vertu du pouvoir législatif accordé aux agents de police selon l'article 50 6) de l'Ordonnance sur la police (cap. 232), qui stipule qu'"au lieu où une personne est appréhendée par un agent de police cet agent est habilité à la fouiller et à prendre possession des journaux, livres ou autres documents, ou de tout extrait ou partie de ces écrits et de tout autre objet ou bien trouvé sur cette personne ou sur le lieu ou près du lieu où elle a été appréhendée, et dont ledit agent de police peut raisonnablement soupçonner l'intérêt (en lui-même ou associé à autre chose) pour l'enquête sur une infraction que cette personne a commise ou est raisonnablement soupçonnée d'avoir commise".
125. Body searches on arrested persons upon arrest are conducted under the legislative power granted to the police officers under section 50(6) of the Police Force Ordinance (Cap. 232), which provides that "(where) any person is apprehended by a police officer it shall be lawful for such officer to search for and take possession of any newspaper, book or other document or any portion or extract therefrom and any other article or chattel which may be found on his person or in or about the place at which he has been apprehended and which the said officer may reasonably suspect to be of value (whether by itself or together with anything else) to the investigation of any offence that the person has committed or is reasonably suspected of having committed".
