On peut toutefois relever une extension du champ d'application de l'article 3 aux risques de traitements inhumains et dégradants liés aux agissements de groupes privés puissants ne présentant pas de liens avec les autorités de l'État de destination si celui-ci n'est pas à même d'offrir à l'intéressé une protection appropriée (arrêt H.LR.c/ France, 29/4/1997, § 39) ainsi qu'aux risques de mauvais traitements provenant de certaines circonstances exceptionnelles -telle que l'expulsion projetée de personnes souffrant d'une maladie arrivée à un stade terminal- qui exposeraient celles-ci à un risque réel de mourir dans des circonstances particulièrement douloureuses et constituerait donc un traitement inhumain (arrêt D. c/ R-U, 2/5/97, §53).
The scope of article 3 has however been extended to the risk of inhuman and degrading treatment associated with the misconduct of powerful private groups which have no links to the authorities of the Receiving State in the event that that State is unable to afford the person concerned appropriate protection (judgment in H.LR. v. France, 24573/94 [1997] ECHR 23, at paragraph 39) as well as to the risk of ill-treatment arising in certain exceptional circumstances which would expose them to a real risk of dying in particularly painful circumstances, such as the planned expulsion of persons who have reached the terminal stage in an illness, and would therefore amount to inhuman treatment.
