This is obviously because these are the only statements communicated to the Secretary—General, but there is no doubt that this fact is of major practical importance: statements made in the above circumstances raise the most problems as far as distinguishing them from reservations or conditional interpretative declarations is concerned, as, by definition, they may be formulated only “when signing, ratifying, formally confirming, accepting, approving or acceding to a treaty, or by a State when making a notification of succession to a treaty. / See draft guidelines 1.1 and 1.2.1 [1.2.4].

A statement made by a State concerning its implementation of a treaty at the internal level can constitute a genuine reservation even if the desire to modify or exclude the legal effect of certain provisions of the treaty or of the treaty as a whole with respect to certain specific aspects as they apply to that State is not immediately clear.

Une déclaration unilatérale faite par un État ou une organisation internationale à l'occasion de l'expression de son consentement à être lié par un traité ou quand un État fait une notification de succession, en conformité avec une clause expresse figurant dans ce traité autorisant les parties ou certaines d'entre elles à exclure ou à modifier l'effet juridique de certaines dispositions du traité dans leur application à ces parties constitue une réserve.
A unilateral statement made by a State or an international organization when expressing its consent to be bound by a treaty or by a State when making a notification of succession, in accordance with a clause in the treaty expressly authorizing the parties or some of them to exclude or to modify the legal effect of certain provisions of the treaty in their application to those parties constitutes a reservation.

21) La Commission s'est demandée en outre s'il convenait d'introduire, dans la définition des déclarations interprétatives, un élément temporel, présent dans celle des réserves "L'expression 'réserve' s'entend d'une déclaration unilatérale (...) faite par un État ou par une organisation internationale à la signature, à la ratification, à l'acte de confirmation formelle, à l'acceptation ou à l'approbation d'un traité ou à l'adhésion à celui—ci ou quand un État fait une notification de succession à un traité..."
