These principles include: the principle of fair and public hearing; the principle of legality of crime and punishment (nulla poena sine lege (no penalty without law) and nullum crimen sine lege (no crime without law)); the principle of the necessity of impartial investigation and fulfilment of rights by the judge; the principle of non-retroactive; and the principle of guiltlessness and equality in the enjoyment of rights.

7. No ha habido cambios en las siguientes disposiciones legislativas que se mencionan en el informe inicial: el artículo 21 de la Constitución de la República de Lituania (en adelante, la Constitución), que prohíbe la tortura en todo el territorio bajo jurisdicción del Estado, y el artículo 145 de la Constitución, que prevé la restricción provisional de los derechos y libertades consagrados en la Constitución al imponerse la ley marcial o declarar el estado de emergencia; los artículos 2 y 41 del Código Penal que establecen que las penas se administrarán únicamente de acuerdo con la ley y con el propósito de la pena; la ley aprobada por el Seimas en 1998, por la que se abolió la pena capital; el Protocolo Nº 6 del Convenio Europeo para la Protección de los Derechos Humanos y de las Libertades Fundamentales.
7. The following legal acts mentioned in the initial report have undergone no changes: Article 21 of the Constitution of the Republic of Lithuania (hereinafter - the Constitution) that prohibits torture practices all over the territory under the jurisdiction of the State and Article 145 of the Constitution that provides possible temporal restriction of rights and freedoms entrenched in the Constitution after imposition of martial law or declaration of a state of emergency; Articles 2 and 41 of the Criminal Code that regulate administration of punishment only under law and according to the purpose of penalty; the law adopted by the Seimas in 1998 that abolished capital punishment; Protocol No 6 to the Convention for the Protection of Human Rights and Fundamental Freedoms.
