337. Under section 13, if a department head intends to disclose information that may have a specific effect on a third party, notice must be given to the third party of the intention to release the information. The third party is given an opportunity to make representations as to why the information should not be disclosed.

On 8 December 2003 the Federal Court concluded that the hearing officer had not erred in determining that certain information was relevant but could not be disclosed for reasons of national security, and confirmed that that information should not be disclosed, but could nevertheless be taken into account by the Court.
