There, the Court held, at paragraph 14 of its judgment, that the description of the act was not relevant and that the question of jurisdiction had to be resolved through a determination of ‘… whether, having regard to its content and all the circumstances in which it was adopted, the act in question is not in reality a decision of the Council’.
