According to article 61 of the Criminal Procedure Code, the accused person enjoys the right to be present at any proceeding that directly concerns him/her; to be heard by the court or by the judge who presides the pre-trial phase subsequent to the investigation (juiz de instrução) in decisions that may affect him/her; to be informed of the facts impending upon him before making any statement; not to answer questions made by any authority on the facts impending upon him and on the content of the statements concerning those facts; to be assisted by a defense lawyer in all procedural acts and to be allowed to communicate in private with him/her; to take part in the investigations and subsequent pre-trial phase, giving evidence and asking for any necessary proceedings; to be informed by the judiciary authority or by the criminal police of the acts where his/her presence is mandatory; to appeal of decisions that are not favorable.
De conformidad con el artículo 61 del Código de Procedimiento Penal, el acusado tiene derecho a estar presente en cualquier proceso que lo afecte directamente; a ser oído por el tribunal o por el juez de instrucción en las decisiones que puedan afectarlo; a ser informado de los hechos que se le imputan, antes de hacer cualquier declaración; a no responder a las preguntas hechas por cualquier autoridad sobre los hechos que se le imputan y sobre el contenido de las declaraciones relativas a esos hechos; a ser asistido por un abogado defensor en todas las actuaciones procesales y a que se le permita comunicarse en privado con este; a participar en las investigaciones y en la fase de instrucción, a presentar pruebas y a pedir cualquier diligencia necesaria; a ser informado por la autoridad judicial o la policía judicial de las actuaciones en que se requiera su presencia; y a recurrir las decisiones que no le sean favorables.
