Este derecho se deriva a su vez del derecho fundamental que todo niño, niña o adolescente a vivir con sus padres o mantener contacto directo con ellos si están separados, correspondiendo al Estado responsabilizarse de este aspecto, en este sentido el objetivo de la Convención de La Haya sobre los aspectos civiles de la sustracción de menores es que los derechos de custodia y visita sean efectivamente cumplidos en los países signatarios de la misma y que alguno de los progenitores o familiares no se valga de las vías de comunicación y la posibilidad de cruzar las fronteras para retener o sustraer al niño, niña o adolescente e ir en contra de estos derechos establecidos ya sea legal, convencional o judicialmente en perjuicio del padre, madre o familiar.
