Section 17 (1) of the Act states that if any person has attained the age of 18 years and has the custody, charge or care of any child or young person under that age and wilfully assaults, ill-treats, neglects, abandons or exposes in any manner likely to cause him unnecessary suffering or injury to health (including injury to or loss of sight, or hearing, or limb, or organ of the body, and any mental derangement), that person is guilty of an offence and is liable upon summary conviction to a fine not exceeding $250 or imprisonment for one year or both or upon conviction before the Supreme Court to a fine not exceeding $1,000 or imprisonment for three years or both.
